By accessing or using Pavilion Picks, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, please do not use our services. These Terms govern your use of the Pavilion Picks platform, including its website and mobile applications (the "Platform").

1. Introduction

Pavilion Picks offers a platform for users to participate in fantasy sports contests and mini-leagues, where users can select teams, participate in contests, and win rewards or prizes. Users can engage in free or paid contests, depending on the type of game they wish to participate in.

2. Acceptance of Terms

By using the Pavilion Picks Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you should immediately cease using the Platform.

Pavilion Picks reserves the right to update or modify these Terms at any time, and any changes will be effective immediately upon posting. We will notify users of significant changes via email or app notifications.

3. User Account

To access and participate in contests on Pavilion Picks, you must create an account. When registering, you will be required to provide the following information:

  • Full name
  • Email address
  • Username
  • Password
  • Team you support

You are required to verify your email address during registration. You are responsible for maintaining the confidentiality of your account credentials. If you believe there has been any unauthorized access to your account, you should notify us immediately.

4. Eligibility

To participate in Paid Contests, you must meet the following criteria:

  • You must be 18 years or older
  • You must reside in India

Restricted States: You agree that you are not from any of the following Restricted States and shall refrain from making any false disclosures, declarations, and/or representations to us to circumvent the applicable laws and regulations of the territory of India:

  • Andhra Pradesh
  • Assam
  • Nagaland
  • Sikkim
  • Telangana

You agree to comply with the laws and regulations of the territory of India regarding participation in Paid Contests.

5. Contests and Leagues

5.1 Contest Participation

  • Users can participate in free and paid contests
  • Paid Contests: To participate, users must pay an entry fee. Payments will be processed through third-party payment providers
  • Users can create mini leagues (public or private) and participate in head-to-head matches

5.2 Prize Distribution

  • Company-managed Prizes: Pavilion Picks will manage the prizes for paid contests and distribute the prize money pool
  • Mini Leagues: Prizes provided by league organizers are non-financial (e.g., merchandise or tokens), and Pavilion Picks is not responsible for these prizes
  • Financial Prizes in Mini Leagues: If financial prizes are provided, Pavilion Picks will manage and distribute these prizes as it does for the paid contests

5.3 Contest Formats

  • Public Contests: Open to all users without restrictions
  • Private Contests: Created by users, and participation is limited to invited users
  • Multiple Entry Contests: Users may create multiple teams in certain contests

6. Payment Terms

  • Platform Fees: Pavilion Picks reserves the right to charge a platform fee for participation in certain contests. This fee will be deducted from the entry fee before distributing the prize pool
  • Payment Processors: Payments for contests will be processed via third-party payment providers, including potential support for cryptocurrency
  • Refunds: Refunds will be provided in the following cases:
    • A contest is canceled by Pavilion Picks
    • A contest fails to meet the required minimum number of participants
    • A user is unable to participate due to technical issues. Refund requests must be made within 30 days of the event

7. User Conduct

You agree to:

  • Use Pavilion Picks for personal, non-commercial purposes only
  • Not engage in any fraudulent activities, such as creating multiple accounts or manipulating contest outcomes
  • Not share or misuse confidential information such as One-Time Passwords (OTPs)
  • Not engage in collusion or insider trading by sharing non-public information to gain an unfair advantage

Penalties for violating these conduct rules may include:

  • Account suspension or permanent deactivation
  • Forfeiture of winnings
  • Legal action in severe cases

8. Intellectual Property

  • Ownership: Pavilion Picks owns the intellectual property rights to all content, software, and technologies used on the Platform, including all trademarks, logos, and proprietary content
  • User Content: By submitting content (e.g., team selections, strategies), you grant Pavilion Picks a worldwide, non-exclusive, royalty-free, and transferable license to use, display, and distribute this content for marketing purposes
  • Logo Usage: You may not use the Pavilion Picks logo or branding without prior written consent. Unauthorized use of the logo for commercial or explicit content purposes is prohibited

9. Dispute Resolution and Jurisdiction

  • Dispute Resolution: If a dispute arises from these Terms or your use of the Platform, the parties will attempt to resolve it through amicable discussions. If unresolved within 30 days, the dispute will be settled through arbitration
  • Arbitration: The arbitration will be conducted in Mumbai, in accordance with the Arbitration and Conciliation Act, 1996. The proceedings will be in English
  • Jurisdiction: The courts of Mumbai shall have exclusive jurisdiction over any legal disputes related to these Terms

10. Liability and Indemnification

  • Limitation of Liability: Pavilion Picks is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use or inability to use the Platform
  • Indemnification: You agree to indemnify Pavilion Picks and its affiliates against any claims, losses, or damages arising from your use of the Platform or any violations of these Terms

11. Privacy and Data Protection

All personal information you provide will be governed by our Privacy Policy, which outlines how we collect, use, store, and protect your data.

12. Force Majeure

Pavilion Picks is not liable for failure to perform any obligation under these Terms if such failure is due to circumstances beyond its reasonable control, including but not limited to acts of nature, war, pandemics, or system failures.

13. Amendment of Terms

Pavilion Picks reserves the right to modify these Terms at any time. If there are significant changes, we will notify you via email or app notifications.
